LIABILITY FOR PAYMENT OF COUNCIL TAX

Members should be aware of recent Court of Appeal decision in the case of Leeds v Broadley (2016). The judgement in this case was that a landlord is not liable for payment of council tax in circumstances were the tenant has vacated the property without giving notice and the landlord has not retaken possession.  In order for this to apply, the tenancy must either be within the period of the written agreement, or, where it continues as a contractual periodic tenancy.  A suitable clause must … [Read more...]

Selective Licensing Liverpool

Members should be aware that despite indications to the contrary on various websites, all rented properties in Liverpool must be licensed.  This has been the law since April 2015 and reports that the selective licensing scheme is somehow illegal are very wide of the mark.  This scheme will remain legal and compulsory unless and until it is declared illegal by the courts.  The possibility of that happening appears to be extremely remote.  If you have not applied for a licence for any of your … [Read more...]
