:: Section 21 in Peril ::
Hard on the heels of recent Tenancy Deposit Legislation, which as we know is something of a fiasco, attempts are now being made to repeal the accelerated possession procedure.
You will know that if this procedure is followed correctly, landlords can recover possession of their own property providing it has been let on an Assured Shorthold basis.
The Legislation does not require Landlords to give any reason for the eviction apart from the fact that the tenancy has come to an end or is within its final two months.
According to a report issued by the Citizen’s Advice Bureau, today, many landlords use this procedure the minute a tenant makes the slightest complaint about repairs. Naturally there are no statistics to back up this preposterous allegation.
Landlords have to pay to use this procedure, the court fees alone being £150.00 and there is often a loss of rent over a period of a few months. No Landlord would therefore use section 21 without good reason.
Often the reason might be that, as has happened to many of our members, the police or the local authority alerts the landlord to anti-social behaviour, drug dealing or other criminal activities.
If the accelerated procedure were to be repealed, our Association is certain that many landlords would quit the business altogether.
As far as we are concerned, this would be the last straw and yet another example of this Government’s determination to regulate landlords in every possible way, to erode profits, and to make life as difficult as possible.
We hope that for once, common sense will prevail and the matter will go no further.
